Following First Franklin’s instructions, I intentionally missed my mortgage payments for the months of July and August of 2007. In September, I called them because I had not heard from anyone regarding my pre-payment plan and that I wanted to know what was going on and if I should make the September payment? At this point in time, I did have the money to make the September payment. A woman told me to hold off on the payment because they had me down in the program and that someone would be calling me, and that they would FIX EVERYTHING. I asked if this was going to damage my credit and where would that put me overall with this loan? She told me that is what the PPP is going to correct.
I finally got the call from Vicky in October from the PPP department from First Franklin. The PPP was as follows. The first payment was going to be 5,681 dollars. It was high because it was going towards the October payment, and also cover the July payment in full. Anything left over would cover the ARREARS. I was told my payments would start on the 30th of every month. My first payment on October 30th, 2007, was supposed to cover the October payment even though my payment schedule USED TO BE ON THE FISRT OF EVERY MONTH. I was told do not worry about the date changing that is what the PPP is for, to figure out what’s best for me.
I made the October payment, then later in the month, on October 22nd I received a NOTICE OF DEFAULT POSTED ON MY HOUSE DOOR. This notice had the name of John Saganaugh on it. I was instructed that after I make the first two payments in October and then in November, I could call them. I was told that the paperwork was being forwarded with the REFI modification department and that I could call in December. I was also advised to call the department so I would not have to finish the PPP because it shows good faith. As, in I am struggling, please help, which shows that I need a modification.
I was not contacted in November or December, but I still continued to make payments. The last payment for my PPP was going to be due on April 30th, 2008. In April of 2008 I received another notice regarding my loan and mortgage. I called them right away and they told me IT WAS A MISTAKE. On April 11th, 2008, there was a TRUSTEE’S DEED UPON SALE on my home, notifying me that my home had been sold. The first thing that came to my mind was wait, I’ve been doing everything they ask of me. HOW COULD THEY FORCLOSE ON ME? I had no idea who exactly foreclosed on me.
I next wrote a letter to the manager of First franklin, and nothing came of that. The next day I took off from work and went to the Ontario Mayors office. They then sent me to the housing department. Housing then sent me to mediation. I was doing anything I possibly could to alarm the bell that SOMETHING WAS TERRIBLY WRONG in my situation. I approached local leaders from local city government all the way up to the Attorney general of California, F.B.I, and many others to try and get answers.
