Mr. Hurst then explained that this address which was on the Correction Deed was the address of DAVID BOUCHARD who was known to be a Sovereign Citizen Guru in San Bernardino County. Mr. Hurst stated based on his training and experience that he recognized the Chisolm v Georgia court case as the founding of the SOVEREIGN CITIZENS MOVEMENT. Wording from Chisolm v Georgia was what Barbara Bratton used ,which she found on the internet, NOTHING MORE.
The SOVEREIGN CITIZEN MOVEMENT is comprised of anti-government extremists who believe that even though they physically reside in this country, they are separate or “sovereign” from the United States. As a result, they believe they don’t have to answer to any government authority, including courts, taxing entities, etc.
RANDALL ISAEFF, my attorney at the time OBJECTED and stated, “ Your honor this is not a SOVEREIGN CITIZEN CASE.” “It’s not relevant to the issues in this case.” Judge Michael A. Smith stated that “it sounds like it is the basis for further investigation by him as to why she did certain things, so it will BE ADMITTED FOR THAT PURPOSE.”
Next the prosecution presented a Warranty Deed which was exhibit four. This was also certified by the San Bernardino County Recorder’s office. The APN number on the top right of the deed said 1014-171-16. The document number as per the County Recorder’s office was 2013-0151327. This was recorded on April 11, 2012, which is the same date as EXHIBIT 3.
The date on the recording of the Grant Deed for Mr. Guevara was November 7, 2012. Mr. Hurst further stated that the document had a letter ‘P’ on the Recorder’s Stamp with the word “counter” on it, which shows that someone actually physically went into the RECORDER’S office to file the deed. P stands for Person at the counter.
Next the prosecution asked the court to take judicial notice of the record of the court of an unlawful detainer action numbered UDRS 1200959. The notary stamp on exhibit 3 and 4 is notarizing the signature of Barbara Bratton the prosecution stated. Mr. Hurst was then asked to state the name of the notary agent, and he replied, Leticia Bautista. Mr. Hurst then testified that that he showed her these documents and that SHE IN FACT STATED THAT SHE NOTARIZED THESE DOCUMENTS, BY VERIFYING THE TIME STAMP AND SIGNATURE, AS WELL AS A DMV PHOTO; Mr. Hurst EXPLAINED HOW HE WAS ABLE TO through this process identfied Barbara AS THE PERSON WHO CAME IN AND FILED THE DEED.
