IT ALL BECOMES CLEAR; I FINALLY TAKE ACTION. (47)

On February 2nd, 2011, I received a packet of legal documents sent to my home. The legal documents were addressing my concern of Rosela Guevara’s name being on my home. From 2008-2011 her name has been on the title of my property. THIS IS WHAT I REALIZED AFTER READING THE LEGAL PACKET SENT TO ME. On February 14th, 2011, I received a call from SPS attempting to cute the debt. They did not give me any information on who or where I was supposed to be paying. When this phone call occurred, I asked them for validation if SPS was still servicing my loan. After this phone call I sent another Qualified Written Response to ask them if they were servicing my loan, and if so to prove it. In March 2011, I filed a complaint against SPS to the Federal trade Commission and other agencies.

On November 4th, 2011, I gave SPS notice that I was intending to sue again, this time it was not for fraud but for WRONGFUL FORECLOSURE! Prior to November 4th, 2011, around October 18th, I RECIEVED A NOTICE OF DEAFAULT FROM U.S BANK, AND QUALITY LOAN SERVICES WAS HANDLING THE FORECLOSURE FOR THE BANK. I fought this. After giving notice of this lawsuit on November 4th, 2011, in February 2012 I actually filed the lawsuit in the Federal District Court Riverside, but it moved to Los Angeles. The first lawsuit that was ever filed on my behalf by my attorney was filed in the Superior Court of San Bernardino, Rancho Cucamonga.

In February of 2012, I filed a LIZ PENDENS with the San Bernardino County Recorder’s Office. A Liz pendens is a written notice that a lawsuit has been filed concerning real estate, involving either the title to the property or a claimed ownership interest in it. After all of this I told myself okay, ENOUGH IS ENOUGH. I MIGHT NOT BE A SAVY REAL ESTATE LAWYER, BUT I KNOW WHEN SOMETHING IS OFF. I FILED THIS TO GIVE constructive notice that there was a lawsuit pending regarding my home.

In January or February of 2012, I received a notice that there was going to be a sale on my property. I was sued by Mr. Guevara in 2012 regarding what he claimed was his property. I unfortunately was representing myself again because I could not afford to pay an attorney.
