NOTICE OF DECISION-TRUSTEE SALE/ DEED UPON SALE REVOKED. (46)

On December 29th, 2009, I received a Notice of Decision which stated that the trustee that conducted the sale RESCINDED the trustee’s sale and the trustees deed upon sale that took place on April 11th, 2008. At this time, I was preparing to serve in court U.S bank, SPS, First Franklin, Home Loan Servicing, Rosela Guevara, South Hills Properties, Doug Jackson & Associates, the eviction lawyer, and Wallace & Company. I was now unfortunately at this time representing myself.

Around December 2009 or January 2010, I was contacted by attorney Gina Albertson. She wanted to know if I received a SECOND NOTICE OF A FORCLOSURE. I told her I did not. She then told me that IF I DID, TO DISREGARD IT BECAUSE IT WAS A MISTAKE. I did not contact SHP, but I did start writing letters to SPS.

I started sending validation letters to validate my debt, who do I owe debt to, and who should I be paying. It is referred to as qualified written requests, WHICH IS A LETTER TO GET DOCUMENTATION FOR THEM TO PROVE THAT THEY ARE WHO THEY SAY THEY ARE. I ALSO SENT OUT A NOTICE OF RECISSION AND A NOTICE OF DECISION. I was sending these letters because I was concerned that I might be sending money to the wrong places because back in October of 2008 SPS sent one of my payments back, STATED THAT THEY HAD NO CONTRACT WITH ME, AND IF I SENT ANY MORE PAYMENTS, THEY WOULD NOT ACCEPT THEM.

This was not sent to me in writing I was told this over the phone. This is why I followed up with the letters. I wanted it in writing. In 2010 I did not make any payments I was just in a lawsuit. Sending the letters out also was helping with discovery in my case. In 2010 SELECT PORTFOLIO NEVER SENT ME ONE STATEMENT OR GAVE ME ANY WRITTEN INSTRUCTIONS OF WERE TO PAY.
