Prosecution’s first Witness BRIAN HURST- Retired Detective: Ontario Police Dept (8).

On Wednesday September 30, 2015, the people called retired police detective Brian Hurst to the stand. Brian hurst was sworn in and asked by Vance Welch, prosecutor, if he was an active detective on the date of June 3rd, 2014. Mr. Hurst was then asked if he was on or around the day of June 3rd involved in an investigation at the property located in Ontario that was my Barbara Bratton’s home. On that day, Brian Hurst stated that he was called out to the Bratton residence, and he was met by Mr. Guevara. THIS IN ACTUALITY WAS A LIE. Mr. Hurst did not go out to the property. Mr. Hurst told the courtroom that Mr. Guevara stated that him and his wife PURCHASE FORECLOSED PROPERTIES, REFURBISH THEM, AND SELL THEM FOR A PROFIT. He also confirmed that he was on active duty on the alleged dates for the Ontario Police Department.

The First Exhibit the prosecution presented was the TRUSTEE’S DEED UPON SALE. It was recorded on May 16, 2012, and the number 2012-0104661 was affixed to it. Brian Hurst stated that he was familiar with the document. Mr. Hurst testified further that one of the papers attached to this 4-page document was a certification from the COUNTY ASESSORS OFFICE, dated March 25th, 2015. Prosecutor Welch directed Mr. Hurst to read “this conveyance is made in compliance with the terms and provisions of the Deed of Trust executed by Barbara R. Bratton, a single woman, as trutor, dated 6-3-2005, and recorded on 7-19-2005, as instrument No. 2005-0517455.

Prosecutor Welch then directed Mr. Hurst to read the part that stated “said property was sold by said Trustee at public auction on 3-12-2012 at the place named in the NOTICE OF SALE, In the County of San Bernardino, California, in which the property is situated. Grantee being the highest bidder at such sale became the purchaser of said property and paid therefore to said Trustee the amount being $231,847.35 in lawful money of the United States or by satisfaction, pro tanto, of the obligation then secured by said DEED of TRUST, dated March 13, 2012. The assessor’s parcel number, which is unique to every individual property has the number 1014-171-16 in the upper left-hand side.

The Second Exhibit the prosecution presented was a GRANT DEED with the number 2012-0462392 in the upper right-hand corner, with the date being recorded as November 7, 2012. Parcel number on exhibit two was 1014-171-16-000.

Prosecutor Vance Welch directed Mr. Hurst to read part of the Grant Deed that read “For a valuable consideration, receipt of which is hereby acknowledged, U.S Bank National Association, as the trustee for the holders of First Franklin Mortgage Loan Trust Mortgage Pass-Through certificates, series 2005-ff9, hereby grants to Salvador A. Guevara, a married man, as his sole and separate property.”
